Welcome, and thank you for your interest in SnackShot (“SnackShot,” “we,” “us,” or “our”). These Terms of Service are a legally binding contract between you and SnackShot regarding your use of the app and related services (collectively, the “Service”).
BY CREATING AN ACCOUNT, SUBSCRIBING, OR OTHERWISE ACCESSING OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS, INCLUDING SNACKSHOT’S PRIVACY POLICY (TOGETHER, THESE “TERMS”). IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT USE THE SERVICE.
SnackShot provides health insights and recommendations based on user-uploaded photos of food and beverages. The Service is for informational purposes only and is not intended to provide medical advice or serve as a substitute for professional medical consultation, diagnosis, or treatment. You should always seek the advice of a qualified healthcare professional with any questions about your health or dietary needs.
You must create an account using sign-in options provided by Apple or Google to access the Service. By creating an account, you represent that all information provided is accurate and up to date.
SnackShot may integrate with third-party tools for analytics, data storage, or processing. Your use of the Service is subject to these third-party tools' terms and conditions, which are incorporated into these Terms by reference. SnackShot is not responsible for the practices of third-party services.
By using the Service, you agree not to:
SnackShot reserves the right to suspend or terminate accounts that violate these terms.
We may terminate or suspend your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
Upon termination, your right to use the Service will cease immediately.
Notwithstanding any damages that you might incur, the entire liability of SnackShot and any of its suppliers under any provision of these Terms and your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by you through the Service or 100 USD if you haven't purchased anything through the Service.
To the maximum extent permitted by applicable law, in no event shall SnackShot or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data, business interruption, personal injury, or loss of privacy) arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of these Terms, even if SnackShot or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.
Some jurisdictions do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply. In these jurisdictions, each party's liability will be limited to the greatest extent permitted by law.
The Service is provided to you "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, SnackShot, on its own behalf and on behalf of its affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory, or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
Without limitation to the foregoing, SnackShot makes no warranty or representation of any kind that the Service will:

In such cases, the exclusions and limitations set forth in this section shall apply to the greatest extent enforceable under applicable law.

Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter, nor shall the waiver of a breach constitute a waiver of any subsequent breach.
These Terms are governed by the laws of the State of California without regard to its conflict of laws principles.
SnackShot reserves the right to modify or discontinue the Service at any time without prior notice. Material changes to these Terms will be communicated to users with at least 30 days' notice. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
